By using Blur Bit (“the Platform”), you agree to comply with and be bound by the following Terms and Conditions (“Agreement”) for Canadian users. If you do not agree to these terms, you must refrain from using our services. Please read this Agreement carefully before proceeding.
1. General Information
Blur Bit is a decentralized platform that allows you to buy cryptocurrencies such as Bitcoin (BTC), Ethereum (ETH), USDC, and USDT through credit card processing and eTransfer services. Blur Bit is not a centralized exchange and does not hold or store any cryptocurrencies on behalf of users. All cryptocurrency transactions are processed through a decentralized wallet system facilitated by a third-party holding wallet.
By using the Platform, you acknowledge and agree that Blur Bit acts solely as an intermediary for facilitating purchases through third-party services and is not the custodian of your digital assets.
2. No Custody of Assets
Non-Custodial Platform:
Blur Bit is a non-custodial platform, meaning we do not hold, manage, or control any digital assets on your behalf. Upon completing a purchase, your cryptocurrency is sent directly to your personal decentralized wallet (via Trust Wallet protocols or other third-party decentralized wallet protocols). We do not retain access to your private keys or wallet addresses at any time.
You are solely responsible for ensuring the security and safe storage of your cryptocurrencies. By using the Platform, you agree that Blur Bit is not liable for any loss, theft, or unauthorized access to your funds once they are transferred to your wallet.
3. Payment Processing and Legal Compliance
Payment Methods:
Blur Bit accepts payments via Credit Card and eTransfer for cryptocurrency purchases. However, it is your responsibility to ensure that using these methods to buy cryptocurrency is compliant with the laws of your jurisdiction. It is completely up to you to ensure that you are legally permitted to use these payment methods for purchasing digital assets.
Legal Compliance:
You acknowledge and agree that you are solely responsible for understanding and complying with all relevant laws, regulations, and legal obligations related to your purchase, use, and sale of cryptocurrencies in Canada. By using the Platform, you affirm that you are not violating any laws, including but not limited to anti-money laundering (AML) and combating the financing of terrorism (CFT) regulations.
You agree to hold Blur Bit harmless for any consequences resulting from non-compliance with applicable laws or regulations.
4. User Responsibilities and Legal Use of Funds
Legal Use of Funds:
You are solely responsible for ensuring that you are using the funds in a manner consistent with the law, and you agree that you will not use Blur Bit to purchase cryptocurrencies for illegal purposes. Blur Bit makes no representations or warranties regarding the legal status of any cryptocurrency purchase or its intended use.
You further agree to comply with any and all laws, statutes, regulations, and orders of any applicable jurisdiction, including those relating to taxes, financial transactions, and cryptocurrency use.
5. Disclaimers and Limitation of Liability
No Custody or Liability for Crypto Assets:
Blur Bit is a decentralized platform and does not hold any cryptocurrency assets on behalf of users. Once your cryptocurrency is transferred to your wallet, Blur Bit is not responsible for any subsequent transactions, withdrawals, or losses. Blur Bit does not guarantee the security or safety of assets in your wallet once the transfer has been completed.
Indemnity and Hold Harmless:
You agree to indemnify, defend, and hold harmless Blur Bit and its officers, directors, employees, agents, contractors, and affiliates from any and all claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Any illegal or unauthorized use of the Platform or any assets purchased via the Platform.
- Any breach of this Agreement or violation of applicable laws, regulations, or obligations by you.
- Any third-party actions or claims relating to the transactions performed through Blur Bit.
6. Risk Acknowledgment
Cryptocurrency transactions involve inherent risks, including but not limited to:
- Market volatility: The value of cryptocurrencies can fluctuate significantly.
- Transaction irreversibility: Cryptocurrency transactions, once completed, cannot be reversed.
- Security risks: While Blur Bit uses trusted protocols for transaction facilitation, the security of your digital assets is ultimately your responsibility. We recommend securing your private keys and using strong security measures for your wallet.
By using Blur Bit, you acknowledge that you are aware of and accept these risks.
7. Identity Policy
Blur Bit does not collect any personal identifying information from users. As a result, we are unable to offer assistance or resolve any disputes relating to identity theft, fraud, or unauthorized transactions.
It is your responsibility to ensure that your identity and payment method comply with applicable laws, as Blur Bit does not vet or verify any transaction.
8. Third-Party Wallets and Trust Protocols
Blur Bit utilizes third-party services, including decentralized wallet protocols such as Trust Wallet, to facilitate the transfer of cryptocurrency. By using the Platform, you acknowledge that Blur Bit is not responsible for the operation or security of these third-party wallets. All transactions are executed via smart contract protocols, and Blur Bit does not store or have access to your private keys or wallet contents.
9. Amendments to Terms and Conditions
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Terms and Conditions on this page. We encourage you to review this Agreement regularly for any updates.
